Divy It Up, LLC Terms and Conditions of Use

Last updated: September 2nd, 2026

Divy It Up is a financial technology platform for group-based money movement, expense settlement, wallet funding, and user-directed transfers—a transactional wallet and tools for managing and settling shared expenses. We operate as a program manager and work with a partner bank so that funds supporting payments and settlement can be held in one or more pooled For Benefit Of (FBO) omnibus accounts and used solely to facilitate transactions between users and related account services.

Divy It Up is a financial technology company, not a bank, and does not offer deposit accounts, savings accounts, or interest-bearing products. Debts and payments recorded on Divy It Up are informal coordination records, not legal advice or guaranteed contracts. We offer the Divy It Up service “as-is” without a warranty. We may stop offering or restrict certain services or features at any time. Feel free to give us feedback. We will listen and always do our best to support you.

We will modify our Terms Of Use and Privacy Policy periodically and post the most current version on this webpage, https://www.divyitup.com/terms. Here are the policies:

Nature of the Wallet

The Divy It Up transactional wallet is provided for payment and settlement purposes only. It is designed so you can send, receive, and settle group-related funds in connection with the Service—not to store value long-term, earn a return, or replace a bank account or savings product.

User funds that pass through our program are held at a partner bank in a For Benefit Of (FBO) account for the benefit of program participants, as described in our program materials and partner arrangements. Divy It Up is not a bank and does not take deposits for interest or savings purposes. Custody and treatment of pooled funds are governed by our partner bank and applicable program documentation.

Funds do not earn interest for users, and you should not treat the wallet as a savings vehicle. Any balance shown reflects amounts available to support pending or completed transactions through the Service, not a deposit product or investment.

Divy It Up acts as program manager of the wallet program; movement of funds is for transactional settlement in line with these Terms and applicable program rules. If you need a traditional deposit or savings relationship, you should maintain that directly with a bank or credit union of your choice.

Terms Of Use

Who can use Divy It Up:

You may use our services only if you agree to these Terms of Service and to the processing of your information as described in our Privacy Policy. You may not use Divy It Up if you are barred from receiving services under the laws of the applicable jurisdiction, if we previously banned your account for violation of these terms, or if you are under the age of 13.

Description:

Divy It Up® (the Service) helps you track informal debts, expenses, and bills, coordinate group splits, and—where available—use a transactional wallet to send, receive, and settle payments. The Service keeps track of the sharing math, provides informal coordination features, and retains records as needed to operate the Service. Wallet balances reflect amounts held to facilitate transactions, not savings or yield. You agree that this service is provided AS-IS and on an AS AVAILABLE basis.

Informal debts:

The website allows users who share a group or are friends on the service to post debts and payments as they please, using wiki-style rules with no explicit permissions. These are calculated into a determination of debts by the Service. You agree that you understand these debts are not legally binding, and represent informal information sharing among roommates, friends, or family. You agree that the Service cannot guarantee the accuracy of information entered by users.

Conditions of use:

You agree that you will use the Service for its intended purpose, and in compliance with all applicable laws and regulations: local, state, and national, and international, as applicable. You agree not to use the service in a fraudulent, disruptive, aggressive, manipulative, for money laundering, or any other inappropriate matter. Divy It Up reserves the right, but has no obligation, to investigate your use of the service for compliance with appropriate use and terminate your access to the Service, or in order to comply with law, regulation, legal process or government request.

What you represent:

You agree to represent yourself honestly, that all of the information you provide is true, correct, and current, to the best of your knowledge, and that you have the necessary rights, power, authority, and age to agree to these Terms and to perform the acts required of you by the agreement.

No warranty:

Divy It Up, LLC does not represent that the Service is error-free, complete, or can be relied upon. THE SERVICE IS PROVIDED ‘AS IS’ AND ‘AS AVAILABLE’ WITH NO WARRANTY OF ANY KIND AND YOU ARE USING THE SERVICE AT YOUR OWN RISK. DIVY IT UP, LLC DISCLAIMS ANY WARRANTY, IMPLIED OR OTHERWISE, REGARDING THE SERVICE, INCLUDING WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, INCLUDING FOR THE SERVICE.

Termination and Refusal of Service:

Your access to the Service may be terminated at any time, for any reason, at Divy It Up’s sole discretion. This includes the right to ban any person from the service who violates the Divy It Up Content Standards described below.

The Software is licensed, not sold. Except for the limited license expressly granted above, Divy It Up, LLC and its licensors retain all right, title, and interest in and to the Software, the Service, the APIs, trademarks (including “Divy” and “Divy It Up”), documentation, and all related intellectual property. Except to the extent that applicable law prohibits this limitation, you may not, and you may not permit any third party to:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, object code, or underlying algorithms, models, or architecture of the Software, APIs, or Service.
  • Modify, adapt, translate, or create derivative works based on the Software, APIs, or Service, or merge them with other software except as we expressly authorize.
  • Circumvent, disable, probe, or tamper with security mechanisms, authentication or session-token controls, rate limits, or cryptographic protections (including envelope encryption and related key-management controls such as AWS KMS).
  • Use automated scrapers, bots, crawlers, or data-mining utilities to access, copy, or extract data from the Software, website, or endpoints, except for standard search-engine indexing that complies with our published robots directives.
  • Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the Software, or use it to provide a competing service or unauthorized hosted offering.

Mobile Application & App Store Terms

If you download or use the Divy It Up iOS or Android application, the following terms apply in addition to the rest of this agreement and are intended to satisfy applicable Apple App Store and Google Play developer requirements.

Acknowledgement

This agreement is between you and Divy It Up, LLC only, not with Apple Inc. (“Apple”), Google LLC (“Google”), or their affiliates. Divy It Up is solely responsible for the Software and its content. Apple and Google have no obligation to furnish any maintenance or support with respect to the Software.

Maintenance and support

Divy It Up, and not Apple or Google, is solely responsible for providing any maintenance and support services with respect to the Software, whether required under these Terms, applicable law, or otherwise. If you have questions about support, contact us as described in Contact Us.

Product claims and intellectual property

Divy It Up, and not Apple or Google, is responsible for addressing any claims by you or any third party relating to the Software or your possession and use of it, including product-liability claims, any claim that the Software fails to conform to a legal or regulatory requirement, claims arising under consumer-protection or similar legislation, and claims that the Software or your use of it infringes a third party’s intellectual-property rights.

Third-party beneficiaries

You acknowledge and agree that Apple and Apple’s subsidiaries, and Google, are third-party beneficiaries of these Terms as they relate to your license of the iOS or Android application. Upon your acceptance of these Terms, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Export control and legal compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You also agree to comply with all applicable local, state, national, and international laws and with the usage rules of the Apple App Store or Google Play, as applicable, when using the Software.

Device Permissions, Telemetry, and Software Updates

Device access

The Software may request permission to interact with native device capabilities so we can provide the Service. You may grant or deny these permissions in your device settings. Denying a permission may limit related features. Examples include:

  • Face ID, Touch ID, or other local biometrics for device unlock of the app (biometric data is processed on your device by the operating system and is not collected by Divy It Up as a biometric identifier).
  • Push notifications for settlement windows, payment reminders, funding requests, and security or account alerts.
  • Camera access to capture receipts or documents you choose to attach to expenses or verification flows.
  • Contacts access, if you enable it, to invite group members. We use only the contacts you select for that invitation.

Telemetry

We may collect diagnostic, crash, performance, and limited usage telemetry to operate, secure, and improve the Software. Collection and use of personal information is described in our Privacy Policy. You can review notification and analytics choices in the app or device settings where those controls are available.

Updates and forced upgrades

Divy It Up may automatically deploy updates, patches, security fixes, or other modifications to the Software, including through the App Store, Google Play, or the web application. You agree that we may require you to install or accept an update to continue using certain features. Failure to apply required updates may impair functionality, security, or ledger synchronization, and may prevent access to wallet, settlement, or payment features until you update.

License Termination & Uninstallation

The license granted in these Terms is effective until terminated by you or by Divy It Up. We may suspend or terminate your license, account, or access to the Software or Service at any time as described under Termination and Refusal of Service and the Cancellation Policy.

Upon termination of your account or license, you must immediately cease all use of the Software and delete or uninstall all copies from your mobile devices, computers, and browsers. Client-side uninstallation does not, by itself, close your account or complete any backend service termination. Wallet, settlement, and compliance records may continue to be processed on our systems as required by these Terms, partner-bank program rules, and applicable law.

License or account termination does not relieve you of obligations regarding pending ledger settlements, outstanding group balances, fees, or wallet withdrawals set forth in the financial and cancellation terms of this agreement. You remain responsible for withdrawing or transferring remaining balances and for completing or otherwise resolving open settlements as required.

Divy It Up does not allow public posting or sharing of content to the broader user community. This includes comments, posts, reviews, messages, images, or other expressive media.

Privacy and Security

In order to provide the services to you we collect some of your Personal Information. We describe our collection and use of personal information in our Privacy Policy, including our Data Classification and Data Sharing Opt-Out Policy. Please review this policy. You must agree to the processing of your data as laid out in that policy in order to use our services.

UNDER NO CIRCUMSTANCES WILL DIVY IT UP, LLC BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES (INCLUDING EMOTIONAL DISTRESS) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER OR NOT YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES SHALL DIVY IT UP, LLC BE LIABLE TO YOU FOR ANY AMOUNT FOR SERVICES RENDERED PURSUANT TO THIS AGREEMENT.

Fees, account services, and electronic payments

For certain services, Divy It Up may charge fees for account services, transaction-related activity, wallet operations, money movement, settlement support, and related financial services. Those fees are not charges for digital content, software licenses, or payment solely to access or unlock the mobile or web application. Fee schedules, eligibility, invoicing, and renewal terms (if any) are described in the app, on our website, or in separate notices and may change as permitted by law and our policies.

When you link a bank account, fund your wallet, request payouts, or authorize ACH or other electronic transfers, you authorize Divy It Up and our bank partners and service providers (including connectivity providers such as Plaid, where used) to initiate and receive transfers you instruct, subject to verification, cutoffs, and program rules. We may delay, hold, reverse, or refuse transactions where permitted or required to comply with law, address fraud or risk, correct errors, or meet partner requirements.

Fee structure, regulated treatment, and platform-specific payment rules should be confirmed with qualified legal counsel; this section is not tax or legal advice.

Cancellation Policy

This section describes how paid subscriptions, wallet balances, and account data are handled when a user, group admin, or Divy It Up initiates a cancellation. It applies to paid Divy It Up subscriptions and to the wallet and account services connected to them.

How to cancel

Any group admin may cancel the paid subscription for their group at any time by visiting account settings or by contacting us at support@divyitup.com.

When cancellation takes effect

Cancellation takes effect at the end of the current monthly billing period. You will retain access to all paid features until that date. We do not prorate or refund the remaining days in a billing period that has already been charged.

No refunds for completed periods

Fees charged for past billing periods are non-refundable. This includes the account service fee and any transaction fees passed through for banking operations that have already been processed.

Wallet balances must be withdrawn before cancellation is complete

If a cancelling group or individual user has a remaining wallet balance, that balance must be withdrawn or transferred prior to the effective cancellation date. Divy It Up will make reasonable efforts to notify users of any outstanding balance.

Unclaimed wallet balances will be held for ninety (90) days after cancellation and returned upon request. After that period, unclaimed balances may be subject to applicable state unclaimed property (escheatment) laws.

Downgrade to Mini (Free)

Rather than cancelling entirely, groups may switch to Mini (free) at any time if they fit Mini caps (at most 2 groups with 4 members each). Mini hides banking, receipt scan, FX, and Divy Voice. Upon switching, groups that exceed those caps are not truncated — switch is refused until the circle is reduced.

No refunds are issued for the current billing period upon downgrade.

Cancellation by Divy It Up

Divy It Up reserves the right to cancel or suspend any account at its sole discretion, including for violation of the Terms of Service, non-payment, or inactivity.

In the event Divy It Up terminates a paid account for reasons other than Terms of Service violations, we will provide a prorated refund for the unused portion of the current billing period. No refund will be provided for terminations resulting from Terms of Service violations.

Effect of cancellation on data

Upon cancellation, your account and group data will be retained for thirty (30) days to allow you to export your records. After that period, your data may be deleted.

Transaction records required for regulatory or legal purposes will be retained as required by law, including records related to money movement, wallet activity, and compliance obligations of Divy It Up and our partner bank.

External Payment Services

Users, at Divy It Up’s sole discretion, may have the ability to access, link to (including deep links), or integrate with external payment services that enable you to send and receive payments outside the Divy It Up website or mobile applications. These links and integrations are provided on an-is and as available basis by the underlying payment service, and you agree that Divy It Up is in no way responsible or liable for transactions and service provided by a third party linked to from Divy It Up’s service.

SMS Services

Divy It Up offers the option to our customers to receive one-time passwords via SMS to verify and secure access to a cell phone number on an account. We do not use SMS for marketing. SMS message frequency varies based on sign-in or verification activity. Message and data rates may apply.

To stop receiving messages, you may remove your phone number from your account settings, or contact support at support@divyitup.com for assistance. You can also text STOP to stop or HELP for help. Phone carriers are not liable for any delays or undelivered messages.

Regulatory disclosure (summary)

Divy It Up is a financial technology platform, not a bank. User funds that flow through the program are held at a partner bank in pooled For Benefit Of (FBO) accounts for transactional and related account purposes. Divy It Up does not offer savings accounts; balances are not interest-bearing and are not intended for long-term storage. Any fees are described as relating to financial operations and account services—not payment for digital content or general access to application functionality. Partner banks and service providers are subject to their own terms and applicable law.
